* Direct visitors to an appropriate consultation or website resource.The Fit Checker operates through ChatGPT, a service provided by OpenAI. A user may be required to sign in to a ChatGPT account before using it.Chat ConversationsWELLROUNDED does not receive or have access to individual conversations that users have with the Fit Checker through the standard custom-GPT interface.Information entered into the Fit Checker is processed by OpenAI under OpenAI’s terms, privacy policy, account settings, and data controls. Whether a conversation may be used by OpenAI to improve its models may depend on the user’s account type and settings.Users should review OpenAI’s privacy and data-control information before using the Fit Checker.Information Submitted SeparatelyWELLROUNDED may receive information if a Fit Checker user separately:* Schedules a consultation;

* Personally identifiable employee or customer records;
* Patient information;

* Information subject to contractual, legal, or regulatory restrictions.The Fit Checker may produce inaccurate, incomplete, or outdated information. Its responses should not be treated as professional advice or relied upon as the sole basis for an important decision.External Actions and IntegrationsAt the time of this Privacy Policy’s Last Updated date, the Fit Checker is not intended to use a custom Action to transmit users’ chat information directly to WELLROUNDED’s CRM, website, or another external service.If WELLROUNDED later adds an Action, app, API connection, lead-submission feature, or other external integration, relevant portions of a user’s input may be transmitted to WELLROUNDED or another service provider. We will update this Privacy Policy and provide any additional notice or consent required before implementing such functionality.4. Client Data and the Business Intelligence AI BuildThis Privacy Policy primarily governs information collected through the public website, public AI assistants, consultations, and pre-engagement communications.Information provided during a client engagement may include:* Financial reports;

Clients remain responsible for confirming that they have the authority to provide the information and for reviewing outputs before making decisions.5. Protected Health Information and HIPAAThe public website, public Fit Checker, general contact forms, and ordinary email communications are not intended to collect protected health information.Please do not submit:* Patient names;
* Medical records;
* Therapy notes;
* Diagnoses;
* Treatment information;
* Insurance identification information;
* Appointment information connected to identifiable patients; or

They do not replace the independent judgment of a business owner, executive, accountant, attorney, financial professional, clinician, human-resources professional, cybersecurity adviser, or other qualified person.Forecasts, projections, financial models, hiring analyses, break-even calculations, scenarios, recommendations, and AI-generated responses are based on the information, assumptions, rules, and data available at the time they are created.Actual results may differ because of factors including:* Changes in revenue, expenses, or cash flow;
* Customer or client demand;
* Employee or contractor performance;
* Staffing availability;
* Cancellations, churn, returns, or lost customers;
* Pricing changes;
* Vendor or payer behavior;
* Hiring outcomes;
* Market or economic conditions;
* Regulatory changes;
* Technology failures;
* Business interruptions; and
* Inaccurate, incomplete, delayed, or outdated data.WELLROUNDED does not guarantee any particular amount of revenue, profit, savings, growth, utilization, productivity, hiring success, valuation, investment return, or business performance unless a specific guarantee is expressly included in a signed client agreement.4. The Business Intelligence AI BuildThe Business Intelligence AI Build is a customized service. Its exact scope varies based on the client’s goals, questions, systems, data quality, integration needs, and business complexity.Depending on the written agreement, deliverables may include:* A decision-mapping session;
* A business data inventory;
* A company metric dictionary;
* A customized management scorecard;
* Forecast and scenario models;
* A private business AI assistant;
* A management question library;
* Validation and accuracy testing;
* Leadership training;
* An executive business review;
* A 90-day decision roadmap; and
* Post-implementation support.A website description of these items does not mean that every engagement includes every item or an unlimited version of any deliverable.The final scope will be stated in the applicable proposal, order form, statement of work, or client agreement.5. Five Questions GuaranteeCertain website materials may describe a Five Questions Guarantee.Under this offer, WELLROUNDED and the prospective client agree in writing on five management questions before the implementation period begins.Subject to the applicable client agreement, WELLROUNDED will work to configure and validate a system that answers those questions using approved company information within 30 days after receiving the required data, access, and client clarification.If the agreed questions cannot be answered within that period, WELLROUNDED may continue working at no additional implementation cost until the agreed validation requirements are met.The guarantee is subject to conditions that may include:* The parties approve the five questions before the implementation period begins;
* The client provides the required data and system access;
* The necessary information exists and is legally available;
* The source data is sufficiently complete and usable;
* The questions remain within the agreed scope;
* The client assigns a responsible contact;
* The client provides timely clarification and decisions; and
* The client complies with payment and contractual obligations.The guarantee does not cover:* Information that does not exist;
* Unavailable or legally restricted data;
* Newly added questions;
* New data sources added after scope approval;
* Changes in business requirements;
* Unlimited revisions or integrations;
* Incorrect source information;
* Third-party system outages; or
* Every question the client may ask in the future.The signed client agreement controls if it differs from a website summary.6. ConsultationsWELLROUNDED may offer free or paid consultations.Current consultation options may include:* A free 15-minute introductory phone conversation; and

* Treat a missed appointment or late cancellation as completed and nonrefundable; or

* Direct users to website resources or consultations.The Fit Checker is not a secure client portal, professional adviser, guaranteed source of accurate information, or substitute for a consultation or written agreement.Responses may be:* Incorrect;
* Incomplete;
* Outdated;
* Overly general;
* Based on misunderstood questions; or
* Unsuitable for a particular business situation.You are responsible for independently reviewing and verifying any information before relying on it.9. ChatGPT and Third-Party AI PlatformThe Fit Checker may operate through ChatGPT, which is provided by OpenAI.Your access to and use of ChatGPT is also governed by OpenAI’s separate terms, privacy policy, product rules, account settings, and availability requirements.WELLROUNDED does not control:* Whether ChatGPT is available;
* Whether a user must sign in;
* Which models are available;
* OpenAI’s processing or retention practices;
* ChatGPT account settings;
* Model behavior;
* Service interruptions; or
* Changes made by OpenAI.WELLROUNDED is not responsible for losses resulting from the availability, performance, output, security, or policies of ChatGPT or another third-party AI platform.10. Public AI ConversationsWELLROUNDED does not receive or have access to users’ individual Fit Checker conversations through the standard custom-GPT interface.If a user separately schedules a consultation, submits a website form, sends an email, calls WELLROUNDED, or provides information through another channel, WELLROUNDED may receive that separately submitted information.Do not assume that information entered into a public AI conversation has been delivered to Samuel or to WELLROUNDED.If you want WELLROUNDED to receive or respond to information, contact WELLROUNDED directly through an approved communication method.11. Actions, Apps, and External IntegrationsThe Fit Checker may not currently use custom Actions, apps, or external API integrations.If WELLROUNDED later adds an Action, app, CRM connection, form submission, email integration, scheduling integration, or other external service, relevant portions of a user’s input may be transmitted to WELLROUNDED or another third party.Any such integration may be subject to:* Additional disclosures;
* User approval;
* A third party’s terms and privacy practices;
* Technical errors or interruptions; and
* Additional data-handling requirements.WELLROUNDED will update its Privacy Policy and other disclosures when reasonably required before implementing material external integrations.12. Accuracy of Website and AI InformationWELLROUNDED makes reasonable efforts to keep website content and approved AI knowledge current.However, the website or AI assistant may contain:* Errors;

* Social Security numbers;

* Information restricted by law, regulation, contract, or confidentiality obligation.Any transfer of client financial, operational, workforce, customer, project, healthcare, or proprietary information should occur only through a process designated or approved by WELLROUNDED.15. Client DataClients are responsible for ensuring that they have the authority to provide data to WELLROUNDED.Clients must not provide information in violation of:* Privacy laws;
* Employment laws;
* Healthcare laws;
* Intellectual-property rights;
* Confidentiality obligations;
* Customer or vendor agreements;
* Software-license terms; or
* Other contractual or legal restrictions.Unless otherwise agreed in writing, clients remain responsible for:* Source-data accuracy;
* Source-data completeness;
* Data classification;
* Legal authority to disclose the data;
* Required notices or consents;
* Retention obligations;
* Recordkeeping requirements; and
* Reviewing outputs before acting on them.Data ownership, permitted processing, storage, confidentiality, security, retention, deletion, return, and portability will be addressed in the applicable client agreement.16. HIPAA and Healthcare InformationThe website and Fit Checker are not intended to receive protected health information.WELLROUNDED is not acting as a healthcare provider, health plan, healthcare clearinghouse, or HIPAA business associate merely because it provides business-intelligence services or makes a website or AI assistant available.If a proposed engagement requires WELLROUNDED to create, receive, maintain, or transmit protected health information on behalf of a covered entity, the parties must determine before any transfer whether a Business Associate Agreement or other privacy and security documentation is required.Clients remain responsible for their own compliance with:* HIPAA;
* The Texas Medical Records Privacy Act;
* Professional licensing requirements;
* Payer agreements;
* Recordkeeping obligations; and

17. Artificial Intelligence LimitationsWELLROUNDED services may include AI-assisted tools that summarize, retrieve, organize, analyze, calculate, explain, or forecast business information.AI outputs may contain:* Errors;

* Misinterpretations;
* Incorrect calculations;
* Outdated assumptions;
* Unsupported recommendations; or
* Responses that fail to account for relevant context.AI outputs must be reviewed by a qualified human before being used for important decisions.You may not treat an AI output as an audit opinion, financial certification, legal conclusion, tax determination, medical recommendation, employment decision, regulatory approval, or guarantee of future results.18.
